Property Sold

Guys,I bid a fence and the person that I originally gave the bid to sold the property. When I called to tell him that I was going to start the job he stated that he had an agreement with the new owners that he would have the fence cleaned and stained. My question is what would you do, have a new contract
drawn up or just go ahead and do it? The only problem I can see is having to mess with two homeowners. If anyone has dealt with situation any help would be greatly appreciated.

I second beemus on this, Just get in there get it done, and get payment at TIME OF SERVICE! Any residential customers, I make them sign our contract agreement, give me their check, we mark PAID by Check #______ on the contract, my guy signs it and gives the homeowner a copy!

I am not sure I understand what you mean. The original homeowner signed you on to do the fence. Now the orginal homeowner said he sold the property yet he is still on the hook to get it done (is it in escrow, did they make settlement?) Don't go ahead and do anything. Your contract is meaningless if the property deed has changed hands. Make sure you know who is whom and what is what.

Ken is dead on with his assesment of the situation.It's sounds as if your contract isn't anything more than fancy toilet paper at this point.Trying to sneak one in under the radar will end up costing you.

However,if you like doing free work and want to risk it,GET R DONE.I'm sure the new property owner will be thrilled with the freebie.If not you'll find out just as soon as they have you served with the papers for the impending lawsuit.

appreciate the advice I really didn't see this coming. My gut instinct told me not to and I plan on turning down the job. Get this the house wasn't even for sale they were looking at the one next to it and ask the guy if he would sell it he shot them a price and they bought (within the week--3 days) everything but the wedding pictures. The previous owner is probably making a killing on this house. Anyways thanks for the advice

My gut instinct told me not to and I plan on turning down the job.

Usually that gut feeling is right,think your pretty smart in turning down,now you can either redo the contract or go about your business.

If they have already closed on the house your "contract" is useless but I would still try to talk to the parties involved to try and get the job. The fence needs to be cleaned and once you have ascertained that both parties agree on it being done and that one of them pays for it I see no problem in getting a new contract that outlines each persons obligation. Get the job is the first priority but do it on new terms that address the new situation.
